Congratulations on your upcoming real estate transaction!

It will be my pleasure to represent your legal interests through closing. The following are some general guidelines for you to keep in mind as we work towards closing together.
 

Professional Inspection

The Buyer(s) will have five (5) business days from the Acceptance Date in order to have a Professional Inspection performed. I will be sure to contact you in the event I receive any communications pertaining to the professional inspection, at which point you can decide whether negotiations for credits and/or repairs may be warranted. If no correspondence relating to the professional inspection is tendered to my office by the Buyer Attorney within the 5-Day deadline, this provision will be waived by the Buyer(s).
 

Loan Approval

The Buyer(s) stipulated loan approval date is reflected in the Loan Contingency provision of the contract. If the Buyer(s) receive a loan approval by this date, we will proceed to schedule closing, otherwise a routine extension may be requested.
 

Title and Survey

Per contract, you will need to purchase a title commitment and survey. I will order both of these items on your behalf, and the costs will be rolled into your closing costs payable to the title company, which can be paid through your proceeds from the sale.
 

Municipal Requirements

To the extent there are any requirements to close imposed by the municipality in which the property is situated, I will guide you in clearing all requirements prior to closing. This may include transfer stamps, a final water reading, and other miscellaneous items. I will advise you of all municipal costs prior to closing, which will need to be paid apart from your closing costs with the title company.
 

Payoff Letter

Just prior to closing, you will need to request a payoff letter from your mortgage company (if any). If there is an underlying mortgage, it will be paid off at closing with your sale proceeds.
 

Closing Documents

I will draft all required closing documents for recording, including the Deed, Affidavit of Title, Bill of Sale, Closing Statement, Transfer Declarations, and any other documents required by the title company to close this transaction.
 

Communications and Notices

I will handle all communications pertaining to the contract or other legal issues, on your behalf.
 

Attorneys Fees

Based on the referral received for legal representation from one of our valued Realtor affiliates, this office will agree to waive our standard $1200 upfront retainer requirement for Attorneys Fees, in favor of accepting a Good Faith Deposit in the amount of $400 towards the full retainer, in order to begin representation.  You will be billed the remaining balance on Attorneys Fees at closing, only if your transaction successfully closes. If your transaction does not successfully close, this office will waive any additional fees, and will apply your initial Good Faith Deposit towards Attorneys Fees on your next real estate transaction.
