Your newly accepted contract is an important first step in the process towards purchasing real estate, and it is our pleasure to be representing your legal interests in reference to this transaction. Please do not hesitate to contact this office 24/7 during this process. Your Attorney will generally respond to all of your inquiries within 1 hour, and never later than 24 hours. We have reviewed your contract, and would like to provide you with the following guidelines and deadlines, as we move towards closing together.

Email Communications & Action Items

In the event any action items are required of you, you will be addressed directly in email so that we can work on these items together. You may be blind copied on other communications issued by this office and will not need to respond, as these communications are for your informational purposes only. Please be careful when responding to emails which may include other parties. The best practice when sending email correspondence is to be sure that only your representatives are included in your emails.

Cash Transaction

If your contract will stipulate that you will be paying cash at closing. Your cash payment at closing incorporates the purchase price of the property, as well as any title insurance costs, and miscellaneous closing costs, as applicable. The Seller Attorney will order title, and will provide an invoice for any title company fees to be paid at closing. Alternatively, please notify your Attorney immediately if you intend to obtain financing.

Title and Survey

You will be provided with an owner’s title insurance policy and survey, both of which are traditionally provided at closing by the Seller, at Seller’s cost. The title insurance policy is designed to ensure that you are receiving clear and valid title at closing, free of defects or liens on title, and the survey is designed to ensure the boundary lines of the property are free from encroachments.

Municipal Building Requirements

To the extent that you intend to build on your vacant land, you should be sure to check directly with the municipal building department where your land is situated to confirm that there are no impediments to building. The municipal building department will be able to provide you with full guidelines and permit requirements, as applicable.

Attorneys Fees

Based on the referral received for legal representation from one of our valued Realtor affiliates, this office will agree to waive our standard $950 upfront retainer requirement for Attorneys Fees, in favor of accepting a Good Faith Deposit in the amount of $400 towards the full retainer, in order to begin representation.  You will be billed the remaining balance on Attorneys Fees at closing, only if your transaction successfully closes. If your transaction does not successfully close, this office will waive any additional fees, and will apply your initial Good Faith Deposit towards Attorneys Fees on your next real estate transaction.
