The following guidelines and deadlines will be useful for you to review, to ensure a smooth process as we work together toward a successful closing together.
 

Email Communications & Action Items

In the event any action items are required of you, you will be addressed directly in email so that we can work on these items together. You may be blind copied on other communications issued by this office and will not need to respond, as these communications are for your informational purposes only. Please be careful when responding to emails which may include other parties. The best practice when sending email correspondence is to be sure that only your representatives are included in your emails.

Loan Application,  Underwriting, and Loan Approval Deadlines

If you are seeking financing for your transaction, your Loan Officer will work with you to ensure that the Loan Application and Underwriting deadlines will be met as indicated in your contract. You can always obtain loan status updates directly from your Loan Officer as you work together to satisfy any conditions raised for loan approval. In order to protect your Earnest Money Deposit, and in case your loan is not fully approved and “Clear to Close” by the Loan Contingency Date outlined in your contract, please be sure to notify this office, and we will be happy to request a routine extension on your behalf.

Bidding and Auction Process

The bidding process for your real estate investment, if applicable, whether in REO, auction, or other transaction types, involves submitting competitive offers to secure the property, often within tight deadlines and specific guidelines set by the seller or auction platform. This process will be expertly managed by your engaged realtor, who will strategize on bid amounts, ensure compliance with bidding requirements, and submit offers on your behalf to maximize your chances of success. Our office will support you by reviewing contracts and providing legal guidance throughout, ensuring a seamless path to closing.

 

Professional Inspection Deadlines

For REO, auction, or bank-owned transactions, we strongly recommend coordinating with your engaged realtor to schedule a professional inspection of the property, as these transactions are often sold “as-is” with limited seller disclosures. A professional inspection can identify potential issues or defects, providing critical insight into the property’s condition. If any major defects or unacceptable conditions are identified, please submit a detailed list of these issues, along with a copy of your professional inspection report, to our office within five (5) business days of the contract acceptance date. Due to the nature of REO and auction transactions, repair negotiations or credits may be limited, but your attorney will diligently advocate on your behalf to address feasible remedies or adjustments within the seller’s constraints.
 

Closing

For REO, auction, or bank-owned transactions, where the buyer may be required to order title, your attorney will coordinate with you and the title company to ensure timely receipt of closing documents prior to your scheduled closing appointment. Whenever possible, your attorney will thoroughly review these documents with you by phone in advance to address any concerns. If advance review isn’t feasible, your attorney will review all closing documents with you by phone during the closing appointment and remain on call throughout the closing to provide support as needed, ensuring compliance with the specific requirements of REO and auction transactions.
 

Attorneys Fees

This office will provide legal representation for a real estate investor engaging in investment property transactions, REO transactions and real estate auctions, including contract review and modifications, title examination, due diligence support, negotiation assistance, closing coordination, risk mitigation, dispute resolution, and regulatory compliance, for processing up to three contracts and bids on an investment property, culminating in one successful closing, for a flat fee of $1200, $400 of which is due immediately, with the balance to be billed at Closing. This retainer covers all attorney fees for the specified services. If no closing occurs, the retainer is non-refundable, and no additional fees will be charged.
