A fully executed contract is an important first step toward purchasing real estate, and we are pleased to represent your legal interests in this transaction. Clear, timely communication is essential: you may contact your attorney anytime by text, email, or phone—24/7, including weekends and holidays—and we aim to respond immediately, generally within 24 hours. Your attorney will review the contract, prepare any needed modifications or addenda, and handle all formal legal correspondence and document drafting  on your behalf through closing. Please review the following guidelines and deadlines as we work toward closing together.
 

Professional Inspection

The Buyer(s) will have five (5) business days from the Acceptance Date in order to have a Professional Inspection performed. Your Attorney contact you in the event any communications are received pertaining to the professional inspection, at which point you can decide whether negotiations for credits and/or repairs may be warranted. If no correspondence relating to the professional inspection is tendered to this office by the Buyer Attorney within the 5-Day deadline, this provision will be waived by the Buyer(s).
 

Loan Approval

The Buyer(s’) stipulated loan approval date is reflected in the Financing provision of the contract. If the Buyer(s) receive(s) a loan approval by this date, we will proceed to schedule closing, otherwise a routine extension may be requested.
 

Title and Survey

Per contract, the Buyer will pay for the cost of the Owner’s title insurance policy (typically a Seller obligation to pay). This is a substantial savings to you, which offsets some of your other closing costs. You will need to provide a Plat of Survey to the Buyer prior to closing, which this office will order on your behalf, and the cost can be paid at closing with your expected sale proceeds.
 

Municipal Requirements

To the extent there are any requirements to close imposed by the municipality in which the property is situated, your Attorney will guide you in clearing all requirements prior to closing. This may include transfer stamps, a final water reading, and other miscellaneous municipal requirements. Your Attorney will advise you of all municipal costs prior to closing, which will need to be paid apart from your closing costs with the title company.
 

Payoff Letter

Just prior to closing, you will need to request a payoff letter from your mortgage company (if any). If there is an underlying mortgage, it will generally be paid off at closing with your sale proceeds.
 

Closing Documents

Your Attorney will draft all required closing documents for recording, including the Deed, Affidavit of Title, Bill of Sale, Closing Statement, Transfer Declarations, and any other documents required by the title company to close the transaction.
 

Communications and Notices

In the event any action items are required of you, you will be addressed directly in email so that we can work on these items together. You may be blind copied on other communications issued by this office and will not need to respond, as these communications are for your informational purposes only. Please be careful when responding to emails which may include other parties. The best practice when sending email correspondence is to be sure that only your representatives are included in your emails.
 

Attorney’s Fees

The total flat fee for these legal services is effectively $400 if your transaction does not close, or $0 if your transaction successfully closes. Per contract, the Buyer’s lender will be paying the cost for your required Owner’s Title Insurance policy (normally a Seller obligation to pay). Accordingly, \this office will agree to proceed with a preliminary Retainer Deposit in the amount of $400 towards the full flat fee retainer, in order to begin representation.  The total fee billed to you at closing will not exceed the cost of the Owner’s Title Insurance policy that is being paid on your behalf by Buyer’s lender, effectively covering all of your Attorney’s Fees. If your transaction does not close, the Retainer Deposit is non-refundable.

In order to formalize the Attorney-Client relationship, please kindly pay the Retainer Deposit of $400 after submitting the intake form below, as we look forward to representing you.
